MALLARD, Chief Judge.
There is no controversy about the facts found by the judge. They are stated by appellant in its brief, and concurred in by the defendants, as follows:
“Before 5 January 1971 CLC Rentals, Inc. (CLC) leased as tenant by (sic) the defendant R. J. RlGGS (Riggs) the land and buildings located at 2011 Bethel Drive in High Point. Shortly before that date CLC entered into an oral agreement with plaintiff whereby plaintiff supplied diesel fuel to CLC at agreed prices.
