On February 27, 1977, David Ray Brown, a prisoner in San Quentin State Prison, filed a petition for habeas corpus in the Superior Court of Marin County contending that the penalty provision of the statute under which he was sentenced was unconstitutional insofar as it provided for a three-year minimum period for eligibility for parole. The People have appealed from an order of the trial court invalidating the three-year provision, and the trial court stayed execution of its order pending this appeal.
