Plaintiff, devisee of Abraham Johnson, by its bill in the present suit predicates its right to the relief prayed for upon certain covenants on the part of the Ohio River Railroad Company, contained,in the deed or contract from Johnson to the railway-company, of February 28, 1883, the same on which Johnson, in a former suit instituted by him against said company, in'January, 1904, sought similar relief, and in which cause this court, on December 18, 1906, modifying and affirming the decree of the circuit court, denied him any relief.
