—In an action by the primary insurer for reimbursement, the plaintiff appeals from an order of the Supreme Court, Suffolk *666County (Jones, J.), entered April 3, 1991, which denied its motion for summary judgment and granted the defendants’ cross motions for summary judgment dismissing the complaint, and for an award of attorneys’ fees to the defendant Linda Friedman.

Ordered that the order is affirmed, with one bill of costs.
