OPINION OF THE COURT

Plaintiff moves to consolidate Actions 1 and 2 both seeking declaratory judgments. Defendants cross-move for summary judgment.1 The summary judgment motion is deemed to have been made by the defendants in both actions. Both motions are granted.

Both cases arise out of a motor vehicle accident on September 3, 1990. Plaintiff’s wife had previously rented a car from Avis Rent-A-Car (Avis) and plaintiff Stephen Radin (Radin) was driving the automobile with his wife’s permission. The car is owned by P.V.
