This is an action to recover $6,213 upon ' a contract of sale contained in a lease. The defendant was the owner of a lot of land, and one William Perkins was the owner of certain buildings upon it. This being the situation of the parties, they entered into a contract *289by which defendant leased the land to Perkins at a rental of $120 per month, and which contained a provision that the buildings should stand as security for the rent,, and that at the expiration of the term Perkins should, have the option either to remove the buildings, or to. require defendant to take them at a…
