PARKER, Circuit Judge.
This was a suit instituted in the court below by the plaintiff, Frederick W. Metzger, against the Western Maryland Railway Company, to recover damages for personal injuries under the Federal Employers’ Liability Act (45 USCA §§ 51-59). The lower court sustained a demurrer to the amended declaration, and plaintiff appealed. We shall refer to the parties in accordance with the positions occupied by them below.
