The defendant was indicted for the murder of George Tait, and was tried and convicted of murder in the second degree, and his punishment fixed at twenty years in the penitentiary. The State’s theory is that the killing was the result of malice, growing out of the fact that, in November, 1894, George Tait, the deceased, was summoned as a witness before the Grand Jury, and gave evidence, which resulted in an indictment against A.
