*51The plaintiff in error was indicted in the criminal court oí Shelby county on a charge of haying committed murder in the first degree upon the body of one Tommy Dolan, was found guilty of the crime charged, with mitigating circumstances, and sentenced to a term of life imprisonment in the state penitentiary. He has appealed to this court, and assigned numerous errors.
The first assignment is that the verdict' is not supported by the evidence.
