The court, in its instructions on the law of voluntary manslaughter, defined that grade of homicide in the language of the Code, § 26-1007. Exception is taken to the following language: “Provocation by words, threats, menaces, or contemptuous gestures shall in no case be sufficient to free the person killing from the guilt and crime of murder.” This language is a part of that used in the Code section defining voluntary manslaughter.
