Venetian Casino Resort, L.L.C. (“Venetian”) appeals the District Court’s dismissal of its complaint against the Equal Employment Opportunity Commission (“EEOC” or “Commission”) on ripeness grounds. The gravamen of this case is Venetian’s contention that EEOC follows an unlawful rule or practice (“disclosure policy”) that permits the agency unilaterally to release privileged documents submitted to EEOC by a private party without first notifying the party.
