This is an action for personal injury. At the close of plaintiff’s testimony there was a motion for a directed verdict which was overruled. At the close of all of the testimony there was a motion for a directed verdict and also a motion to dismiss the case on the ground of failure of proof, which motions were overruled a.rd after verdict the defendant moved for judgment notwithstanding the verdict or for a new trial, which motion was overruled and the defendant appeals from the order of the district court denying defendant’s motion for judgment notwithstanding the verdict or for a new trial.
