This action is brought by the State of North Dakota for the benefit of the Workmen’s Compensation Fund of the State and Lucille E. Thompson pursuant to the provi sions of § 65-0109, Rev Code ND 1943, to recover damages-arising out of the injury of Lucille E. Thompson, an employee. The defendants appeal from a judgment entered pursuant to-a verdict of a jury. The defendants moved for a directed verdict which was overruled hy the trial court and, among several points raised on appeal, challenge the sufficiency of the evidence-to sustain the verdict.
