This is an appeal from a judgment and sentence of the county court of Payne county wherein the defendant, Ed Shiever, was sentenced to pay a fine of $100 and serve six months imprisonment in the county jail upon, conviction for the crime of driving an automobile on the public highway-while under the influence of intoxicating liquor.

Two propositions are presented in the brief of defendant: (1) The court ei’red in not granting defendant 24 hours delay before requiring him to enter his plea after the information had been amended. (2) The sentence was excessive.
