The complainants have sought and obtained a preliminary injunction restraining defendant from the threatened infringement of their patent, and the question is whether the preliminary injunction should have been granted upon the facts as disclosed by the affidavits, or whether relief should have been withheld until a hearing upon the merits.

The patent in suit is for an invention known in the trade as a mo-tometer, and it relates to a system for indicating the condition of internal combustion engines, and particularly engines with water-jacketed cylinders. It…
