PHELPS, Justice.

This is an appeal from (1) a judgment n. o. v. against plaintiff and in favor of defendant John C. Mullins, and (2) from a judgment in favor of John B. Mills and Bernice Mills, his wife, upon an instructed verdict by the court, and (3) from an order denying plaintiff’s motion for a new trial as to these defendants. Defendant Mullins cross-appealed from an order denying defendant’s motion for a summary judgment and motion for a directed verdict upon the ground that the contract for a commission was an illegal contract because the pleadings and evidence showed the plaintiff was…
