Poole, (hereinafter Poole), a sublessee of an industrial project, and Marsh & McLennan, Inc., (hereinafter appellant) — an insurance brokerage firm. Poole brought a third-party complaint against appellant seeking damages under several theories including negligent failure to procure insurance and breach of contract.
