Defendant, with Ben Arnold and Andy Smart, was charged by information with stealing thirty head of cattle, the property of Mary Johnson. lie was granted a separate trial. Judgment was entered on a verdict finding him guilty as charged; motion for a new trial was denied. He appeals from the judgment and the order denying a new trial.
