Action by appellee to recover damages for alleged malicious prosecution. It is averred in the complaint that, on or about November 28, 1922, the appellant falsely, maliciously, and, without probable cause, procured appellee to be indicted by the grand jury of Boone county, for the crime of embezzlement, by reason whereof, appellant was arrested and held by the sheriff and was compelled to give bail in the sum of $1,000 to procure his release.
