I. This is the third appearance of this case in this court. See Dickson v. Young, 199 Iowa 589; Dickson v. Young, 202 Iowa 378. The action was commenced by appellant to recover damages for an alleged malicious prosecution in the United States District Court at Ottumwa, under the Espionage Act of June, 1917. The prosecution was instituted in January, 1920, by the filing of an information signed by the appellee Young.
