MONROE, J.
Plaintiff applied to the district court for a writ of injunction to restrain the city of New Orleans and the Metropolitan Construction Company (of Kansas City) from further proceeding in the matter of the paving by that company of City Park avenue, from Bayou St. John to Canal street, with “mineral rubber asphaltic cement, known as ‘Sarco road compound,’ ” and manufactured by the Standard Asphalt Rubber Company, of Chicago.
