SUMMARY

This is an action by plaintiff SMS Marketing & Communications, Inc. (“SMS”) against defendants H.G. Telecom, Inc. (“HG”), LINQ Telecom, Inc. (“LINQ”), Travis Hamer (“Hamer”) and Ralph Senter (“Senter”) for breach of contract, fraud, unjust enrichment and violations of the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. § 1961 et seq. Defendants move to dismiss the complaint under the doctrine of res judi-cata and pursuant to Fed.R.Civ.P. 12(b)(6) and 12(b)(2). For the reasons set forth below, the defendants’ motion should be…
