WESTENHAVER, District Judge.

This cause is now before me on a petition of the bankrupt to review an order of the referee in the matter of the bankrupt’s exemption in lieu of a homestead.

*246The facts are agreed, and will be briefly stated. The bankrupt is married and living with his wife and entitled to claim a family homestead, under section 11730, Gen. Code, or an allowance in lieu thereof, under sections 11737 and 11738, Gen. Code. He was adjudicated a bankrupt March 21, 1917.
