OPINION
COLE, Circuit Judge.
Tracy Passa claims that the City of Columbus’s “Check Resolution Mediation Program” (the “Program”) violates both federal and state laws. The district court found that Passa had failed to state a claim on which relief can be granted. In doing so, the district court referred to the city’s website, which stated the purpose of the program. Because the website is not a public record of which judicial notice would be appropriate during a motion to dismiss for failure to state a claim, we VACATE the judgment of the district court, and REMAND for proceedings consistent…
