The defendant corporation was the owner.of and operated a railroad extending from the city of Manitou to the summit of Pike’s Peak and was also the owner of certain buildings upon the summit of the peak. These buildings were leased to the defendant Hiestand, who used them for the purpose of maintaining a hotel and curio store. The rental paid by Hiestand to the corporation was twenty-five per cent, of the gross receipts.
