Respondent moves to dismiss this appeal for the reason that no appeal bond has been executed or filed as required by the statute. The judgment appealed from was entered pursuant to an order sustaining the respondent’s demurrer to appellant’s cómplaint, appellant having elected to stand on its complaint, and the action having been accordingly dismissed on the merits.
