Appellant, as assignee for the benefit of creditors of Singer & Wheeler, a corporation organized under the laws of this State to engage in and carry on a wholesale drug business, brought his action of replevin in the Peoria circuit court against appellee to recover certain warehouse receipts for two hundred and twenty barrels of whisky which had been issued to said Singer & Wheeler, and also to recover the whisky.
