WISDOM, Circuit Judge:

This is a class action filed by plaintiff landowners 1 against Humble Oil & Refining Company, their mineral lessee, seeking an accounting for the alleged drainage of oil and gas from beneath their leased premises caused by Humble’s operations on adjoining premises. In the alternative, the plaintiffs seek damages for the alleged breach of Humble’s implied obligation to exercise reasonable diligence to protect their property from drainage. Federal jurisdiction is based upon diversity of citizenship under 28 U.S.C. § 1332. The principles therefore to be applied in this case…
