KAUTZ, Justice.

[1Í1] A jury convicted Tamani T’Angelis Thompson of three counts of aggravated assault and battery and one count of domestic battery (third offense) for an attack upon his girlfriend (hereinafter referred to as “the victim”). It acquitted him of one count of aggravated assault and battery. Mr. Thompson admitted his criminal record made him a habitual criminal. Consequently, the district court sentenced him to enhanced penalties under the habitual criminal statute.
