Introduction

Plaintiffs Skogquist Trucking and Excavating, Inc. (“Skogquist”), Darrell Nelson d/b/a D & N Trucking, Inc. (“D & N”), and Walters Rubbish, Inc. (“Walters”) (collectively “Plaintiffs”) commenced these actions against Defendant Minnesota Workers’ Compensation Assigned Risk Plan (“ARP”) seeking, inter alia, a declaratory judgment that the Employee Retirement Income Security Act of 1974 (“ERISA”), codified at 29 U.S.C. §§ 1001-1461, preempts Minnesota Statutes sections 176 and 79A and that they accordingly are not liable for insurance…
