Affirming.
This is a suit by appellant, A. M. Emler, against the appellees, H. I. Fox and S. J. Nathan, wherein the plaintiff seeks to recover damages of the defendants for an alleged malicious prosecution which they instituted against him before a justice of the peace for Jefferson County. At the time the plaintiff was sheriff of that county, and by virtue of his office was chairman of the county board of election commissioners.
