—In an action to recover damages for personal injuries, the defendant William Burrows appeals from an order of the Supreme Court, Westchester County (Fredman, J.), entered November *4211, 1999, which denied his motion for summary judgment dismissing the complaint insofar as asserted against him.

Ordered that the order is affirmed, with costs.

In support of his motion for summary judgment, the appellant submitted, inter alia, a radiology report stating that X-rays of the plaintiffs cervical spine taken on the day of the accident revealed some narrowing of the intervertebral space of C5-6 and C6-7. In…
