OPINION

LARSEN, Justice.

This is an appeal by the state from the trial court’s order granting a writ of habeas corpus in favor of appellee. We reverse.

PROCEDURAL HISTORY AND FACTUAL BACKGROUND

This case originates out of the operation of the “L & L Gentlemen’s Club,” a business located at 5813 E. Paisano in El Paso, El Paso County, Texas. Pursuant to Chapter 59 of the Texas Code of Criminal Procedure, the State of Texas seized the real property at 5813 E.
