This is a controversy between the receiver of an insolvent national bank and an assignee of the estate of J. J. Riethmann who was its president, and of J. J. Riethmann & Co., a firm composed of the president and others.

The German National Bank was organized under the federal statutes and did business up to the 7th of June, 1894. On that date the bank was insolvent and closed its doors and was placed in the hands of a receiver by the federal authorities.
