Appeal by the plaintiff, Suzette Jackson, from a judgment of the Supreme Court in .favor of the defendant, entered in the office of the clerk of the county of Fulton on the 5th day of February, 1903, upon the dismissal of the complaint by direction of the court after a trial at the Fulton Trial Term.

Chase, J.:

The defendant is an attorney and counselor at law. This action has been twice tried. The evidence now before us is materially different from the evidence presented to us on the 'former appeal. (Jackson v. Moore, 72 App. Div. 217.) On November 10, 1896, the plaintiff and her two brothers, Paul and George, conveyed to one K. certain real property, and on the same day an agreement was entered into by and between K. of the first part and the plaintiff and her two brothers of the second part, by which K. agreed to pay and discharge certain mortgages on said real property and certain…
