Affirming in part and reversing in part.

Bill Bowling and his employer, the Marian Mining Company, had both accepted the provisions of the Workmen’s Compensation Act (Ky. Stats., sec. 4880, et sea). Bowling died as the result of an accident occurring on September 27, 1928, and arising out of, and in the course of, his employment. P. W. Bowling, the father of Bill Bowling, on behalf of himself and the three half-brothers of the decedent, applied for compensation to ■ the Workmen’s Compensation Board, which rejected their claim.
