Motion sequence numbers 001 and 002 are consolidated for disposition. Under motion sequence number 001, the petitioner Bret A. Grebow moves for an order, inter alia, setting aside the sale of a certain motor vehicle by the New York City Marshal Jeffrey Rose (Marshal Rose or Rose) to one Harvey Weisman (Weisman) and to return it to his possession. The City of New York, New York City Department of Finance, New York City Department of Transportation, and the New York City Parking Violations Bureau (collectively the City), and Rose oppose the same.
