By an action instituted in 1965 the plaintiff sought to recover from the defendant a default judgment which the plaintiff had obtained against Raymond Lessard, the defendant’s insured, arising out of an automobile accident on April 1, 1961 in Amherst, New Hampshire. The Court (Griffith, J. ) made findings of fact and reserved and transferred without ruling the question whether under these findings the plaintiff is entitled to a verdict.

Lessard notified the defendant of the accident shortly after its occurrence and the defendant had the matter investigated by an independent adjusting agency.…
