KEMP, J.

The libelant, Ernest Theodore West, filed bis libel for divorce against bis wife, Dessie Aliene West, on November 17, 1938. The libelee, although a nonresident, appeared by attorney and admitted the marriage but denied all of the other allegations of the libel.

It appearing that the libelant was an enlisted man in the United States Navy, the circuit judge had a hearing upon the preliminary question of whether the libelant had met the prerequisite to jurisdiction of an action for divorce in respect to residence.
