OPINION

EVANS, Chief Justice.

The State brought this action to obtain an order of forfeiture of a sum of money recovered by police officers during the seizure of heroin at appellant’s residence. Af ter a hearing, the court awarded the State the sum of $10,000, being the amount recovered during the narcotics raid.

The sole question raised by appellant’s point of error is whether the State proved by a preponderance of the evidence that the money recovered was subject to forfeiture under the terms of the Texas Controlled Substances Act. Tex.Rev.Civ.Stat.Ann. art. 4476-15 §§ 5.03(a), 5.07(b) (Vernon…
