This was an action against the estate of the driver of an automobile by a guest to recover damages for personal injuries suffered in an automobile accident in Oklahoma caused by the alleged negligence of the driver.

The case was here before and the decision therein is reported in 141 Kan. 195, 40 P. 2d 396. The main question determined in the earlier decision was as to the jurisdiction of the Kansas court, which obtained jurisdiction of the parties, to hear and determine the common-law liability of the defendant for injuries sustained in…
