MEMORANDUM OPINION

This motion is presently before the Court on the defendant’s motion for summary judgment to dismiss plaintiff’s complaint, or in the alternative, partial summary judgment on the issue of punitive damages. The plaintiff’s complaint alleges tortious breach of contract, breach of fiduciary duties, and fraud in the inducement resulting from a one car accident which occurred on June 4, 1983 at approximately 5:20 pm on Lamey Bridge Road in North Biloxi, Mississippi.
