BOHANON, District Judge.

This matter comes before the court on the motion of Defendant, United States of America (“Government”), to dismiss the above-entitled action on two separate grounds. First, the government argues that Plaintiffs’ complaint fails to satisfy the jurisdictional prerequisites of the Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§ 1346, 2671 et seq. In addition, the government contends that Plaintiffs’ assault and battery claim is not cognizable under the FTCA.
