In an action to recover damages for personal injuries, the defendant and third-party plaintiff Atlas Construction Corp. appeals from an order of the Supreme Court, Queens County (Hentel, J.), entered May 2, 1988, which *915denied its motion for a protective order with respect to a notice to admit served by the third-party defendant Rogers & Sons Building Corp.

Ordered that the order is affirmed, with costs.
