O'DELL v. Town of Gauley Bridge
West Virginia Supreme Court
1Opinion of the Court
MILLER, Justice:
These three cases were consolidated for decision because they present similar issues with regard to provisions of the West Virginia “Governmental Tort Claims and Insurance Reform Act,” W.Va.Code, 29-12A-1, et seq. Specifically, the plaintiffs below challenge rulings of the lower courts to the effect that W.Va.Code, 29-12A-5(a)(ll), confers immunity from suit upon political subdivisions of the State in person al injury actions where the claim or loss results from a claim covered by workers’ compensation or employer’s liability laws. 1

The facts in each case are undisputed.
