These appeals involve a dispute between the Lawrence County Board of Education ("the Board") and its superintendent over the Board's unilateral dismissal of its former custodian of school funds ("CSF") and its subsequent hiring of another person to fill that same position.

In setting forth the facts, we are mindful that these appeals are from a summary judgment. Therefore, we must consider the evidence presented to the trial court in a light most favorable to Collins and Stephenson, the nonmoving parties. See, e.g., Fincherv. Robinson Bros. Lincoln-Mercury, Inc., 583 So.2d 256 (Ala. 1991).
