A grand jury indicted defendants Brian S. Beal and Franklin D. Robinson for conspira cy to distribute cocaine base in violation of 21 U.S.C. §§ 841(a)(1) and 846, .and possession of cocaine base with intent to distribute in violation of 21 U.S.C. § 841(a)(1), and 18 U.S.C. § 2. Both defendants filed motions to suppress evidence, challenging the legality of the stop prior to their arrests and the seizure of the controlled substance.
