Appeal from an order of the Supreme Court (Viscardi, J.), entered March 4, 1994 in Essex County, which, inter alia, granted defendant’s motion for summary judgment dismissing the complaint.

In August 1986, defendant was the successful bidder on a 2.56-acre parcel of property located in the Village of Lake Placid, Essex County, which was offered for sale by Placid Memorial Hospital (hereinafter the hospital).
