OPINION AND ORDER DENYING DEFENDANT’S MOTION TO REMAND OR ENFORCE STATE PROSECUTOR’S PLEA BARGAIN

I. INTRODUCTION

Defendant Spence Bernard Gray is charged in a March 3, 2004 indictment with being a felon in possession of a firearm in violation of 18 U.S.C. § 922(g). Through the present motion, Defendant seeks a “remand” of this case to state court so that he can obtain the benefit of a plea bargain that was offered to him, but that he rejected, in the course of state court proceedings arising from the same underlying April 21, 2003 act of firearm possession.
