HUNTER, Associate Justice.
This suit was brought by Harvey Dick against the appellant railroad company to recover damages for an assault and battery committed on the plaintiff on its station and depot grounds, while, as he alleges, the relation of passenger and carrier existed between him and the company. The defense was a general denial. The verdict and judgment in the District Court went against the company for $800, and it has appealed.
